Terms and Conditions

These Terms govern the use of matchaskill (the "Service"). By creating an account or using the Service you accept them. If you do so on behalf of a company, you confirm you have authority to bind it.

1. What the Service is

matchaskill lets you publish a role, invite candidates and run a video interview conducted by an AI agent, which is transcribed and turned into a competency report. The Service is a decision-support tool; it hires and rejects no one on its own.

2. Account

• The Service is for professional use. You must be of legal age.
• Registration details must be accurate and kept up to date.
• You are responsible for keeping your credentials confidential and for activity on your account.

3. Plans, interviews and payment

• There is a free plan with a limited number of interviews per month and paid plans with a larger allowance. The unit of consumption is the AI interview, not the number of users.
• Once the allowance runs out you may purchase additional interviews at the prices published on the pricing page.
• Plans renew automatically until cancelled. Cancellation takes effect at the end of the paid period and does not trigger a pro-rata refund unless applicable law says otherwise.
• We may change prices with at least thirty days' notice; the change applies at the next renewal.
• Prices are stated in US dollars and exclude taxes.

4. Acceptable use

You may not use the Service to:

• Evaluate people without telling them the interview is recorded and scored by AI.
• Collect sensitive data unnecessary for the role, or ask discriminatory questions.
• Impersonate others, resell access, or share credentials outside your organisation.
• Reverse engineer, scrape, or attempt to circumvent your plan's limits.
• Any unlawful purpose, or one contrary to applicable employment and anti-discrimination law.

5. Your obligations towards candidates

When you use the Service to evaluate candidates, you are the controller of that personal data and matchaskill acts as a processor on your behalf. Accordingly you undertake to:

• Tell the candidate, before the interview, that it will be recorded and scored by AI, and obtain their consent.
• Have a legal basis for the processing and respect the data subject's rights.
• Keep human review of every decision. Using the Service's score or recommendation as the sole ground for rejecting a person is expressly prohibited. Peruvian law and the GDPR both recognise the right not to be subject to decisions based solely on automated processing in employment matters.
• Handle access, rectification, cancellation, objection and portability requests candidates address to you.
• Define retention periods and ask us to delete data where appropriate.

The processing terms form part of these Terms and are complemented by our Privacy Policy.

6. About the AI

• The report is generated with language models and may contain errors or inaccuracies.
• We do not warrant that the score predicts anyone's job performance.
• You define the questions, focus areas and competencies for each role, and you are responsible for their relevance and legality.
• We allow and do not penalise candidates using AI tools: the Service measures judgment and understanding, not memory.

7. Intellectual property

The Service, its software, brand and design belong to matchaskill. Content you upload — roles, questions, files — remains yours; you grant us a limited, non-exclusive, revocable licence to host and process it for the sole purpose of providing the Service. We do not use your content or your candidates' data to train models.

8. Availability and support

We work to keep the Service available but offer no service-level agreement on the free plan. We may carry out maintenance and modify or discontinue features, giving reasonable notice where the change is material.

9. Suspension and termination

You may close your account at any time. We may suspend or close it if you breach these Terms, in cases of fraudulent use, or where there is a security risk, telling you the reason unless the law prevents it. On termination we delete or return data as set out in the Privacy Policy.

10. Liability

The Service is provided "as is". To the fullest extent permitted by law, our total liability to you is limited to the amount you paid in the twelve months before the event giving rise to it, and we are not liable for lost profits or indirect damages. None of this limits liability that the law does not allow to be excluded.

You will indemnify us against third-party claims arising from your use of the Service in breach of these Terms, in particular claims about failing to inform candidates or obtain their consent.

11. Changes to these Terms

We may update these Terms. We will give at least thirty days' notice of material changes; continuing to use the Service means you accept them.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Peru. Any dispute will be submitted to the courts of the judicial district of Lima, without prejudice to any rights consumer legislation grants to someone contracting as a consumer.
